Many guys and gals know they have to meet their honey in person and prove it. There are many reasons why they won't or can't go visit him or her as required by the k1 visa process, so they try for a visitor visa.
If a foreign lady from a poor country is single, she has almost zero chance of getting a visitor visa! The applying person needs to PROVE a strong reason to return. That's the main problem.
The Consular Adjudicators suspect he or she is coming to look for a potential spouse so they can stay here. Many of them simply want to get here where they will be free and can get rich. The statistics show that 30% overstay their visa and never go back, becoming illegal aliens, if caught, they get deported and banned from the US on any kind of visa. They then end up working for unscrupulous individuals, families, or whatever, for peanuts. They are not given time off, and when they push their "employer" are told they will be reported to the "INS" and deported.
Rather than taking a chance of having them here illegally and not being able to find them, the US Consulate adjudicators will simply deny the visa. However, if the person managed to get a visitor visa in the past, and never overstayed, then there's a chance of getting another one.
You cannot help the person get the visa and neither can a lawyer. If a lawyer says they can help, they're liars!
A visitor visa is a political visa - meaning it has no purpose other than just coming to the US. It's is therefore not a sponsored visa. The applicant must apply by their self. They must prove they have absolute reason to return home, or have a thriving business that requires them to be home attending it. Large property holdings are useful, but a million dollars in the banks means nothing because it could be put there by someone else and withdrawn the day after the visa was issued.
If the visa applicant claims the reason is to see her boyfriend, she will not get the visa because it will be seen as an attempt to get around the normal process of a K-1 or Relative visa.
If they say they want to see Disneyland, then the officer will consider what he/she earns per year and estimate the cost of the trip, meals and motels to see what percent of his/her income that amounts to. The visa will be denied.
Getting a visitor visa is next to impossible without demonstrating wealth of some sort as needed to return. It will cost at least $500 to go through the process only to be turned down. Forget it.....
Should you meet and fall for a visiting student, email or call us. That we can usually swing without him or him/her having to go back first. There IS a way to skin that cat and avoid the K1 visa process, K3 visa or marriage visa!
